These Terms and Conditions govern the sale of FertilitySmart-branded products by Cognitive Bioscience Ltd (“FertilitySmart”, “we”, “us”) to you through this website (www.fertility-smart.net). Please read them carefully before you place an order. By placing an order, you confirm that you agree to be bound by these Terms.
Nothing in these Terms reduces or replaces your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other UK consumer protection law.

2. How a contract is formed
When you place an order on our website, that is an offer by you to buy the products at the stated price and on these Terms. We accept your offer when we send you a Dispatch Confirmation email confirming we have sent the goods. The contract between you and us is formed at the point we send that email.
We may decline to accept your order, in which case we will refund any payment in full. Reasons might include the product being out of stock, an error in the listed price, or a delivery address we cannot ship to.
3. Your statutory cancellation right under the Consumer Contracts Regulations 2013
Because you are buying from us at distance (online), you have a statutory right to cancel your order without giving a reason. This right applies in addition to anything else in these Terms.
- Cancellation period: 14 days from the day you receive the goods.
- How to cancel: tell us in writing (email is fine) that you want to cancel. You can email customerservice@fertility-smart.net.
- Return window: send the goods back to us within 14 days of telling us you wish to cancel.
- Refund: we will refund you within 14 days of receiving the returned goods (or, if earlier, from when you provide evidence you have returned them). Refunds are processed to the original payment method.
- Cost of return: you pay the cost of returning the goods.
- Condition: goods must be returned in saleable condition. Supplement bottles are not exempt under the “sealed for hygiene” rule — you can return opened bottles within the 14-day cooling-off period, although we may make a reduction proportionate to any handling beyond what is needed to inspect the goods.
4. Your statutory rights under the Consumer Rights Act 2015
UK consumer law requires the goods we sell to be:
- Of satisfactory quality — meeting the standard a reasonable person would consider acceptable.
- As described — matching the description on the website.
- Fit for purpose — suitable for the use described.
If goods do not meet these standards, your remedies under the Consumer Rights Act are:
- 0 to 30 days from delivery: short-term right to reject — full refund.
- 30 days to 6 months: right to repair or replacement; if that is not possible, you can ask for a refund.
- 6 months to 6 years: same remedies, but the burden of proof shifts to you.
These rights are in addition to your 14-day cancellation right under the Consumer Contracts Regulations 2013, and to the Pregnancy Refund Offer (Section 7).
5. Pricing, payment, and currency
Prices on the website are shown in pound sterling (£) and include UK VAT where applicable. Delivery costs are shown at checkout before you confirm the order.
We accept payment by Visa, Mastercard, and PayPal. Card payments are processed by our payment provider; we do not store your full card details.
We reserve the right to correct errors in pricing. If we discover an error after you place an order, we will contact you and give you the option to either continue at the corrected price or cancel for a full refund.
6. Delivery and risk
We aim to dispatch UK orders within 24 working hours of receiving them. Delivery typically arrives within 2–5 business days. International orders may take longer; estimated times are shown at checkout.
Title and risk of loss or damage pass to you on delivery of the goods to the address you supplied (consistent with the Consumer Rights Act 2015). If the goods are damaged in transit, contact us and we will resolve the issue under your statutory rights.
If your order does not arrive, please contact us. We will investigate with the carrier; in line with most carrier policies we typically need to wait 10 working days from dispatch before raising a non-arrival claim.

7. The Pregnancy Refund Offer
If you become pregnant before finishing a 3 month or 6 month supply of FertilitySmart, you can claim a refund on the unopened, unused bottles under our Pregnancy Refund Offer. The full terms of the offer are on that page and form part of these Terms.
The Pregnancy Refund Offer is a refund policy on unused product, not a guarantee of conception. It is in addition to, and does not replace, your statutory cancellation rights under the Consumer Contracts Regulations 2013 or your rights under the Consumer Rights Act 2015.
8. Promotional codes and offers
From time to time we run promotions (for example a multi-buy offer or a percentage-off discount). The following rules apply to those promotions, unless we state otherwise:
- Promotional codes are normally one use per customer.
- Promotional codes cannot usually be combined with another offer on the same order.
- Any specific promotion-only conditions will be stated at the point we run the promotion.
Important: promotional rules do not override your statutory rights. If a product bought on promotion is faulty, not as described, or not fit for purpose, your full statutory remedies under the Consumer Rights Act 2015 still apply, and you keep the statutory 14-day cancellation right under the Consumer Contracts Regulations 2013.
9. Returns process
To return goods under any of the rights above:
- Email customerservice@fertility-smart.net with your order number and a brief note of the reason for return.
- We will reply with the return address and (where applicable) a returns reference.
- Send the goods back to that address. We recommend obtaining proof of posting.
- Once we receive the returned goods and check them, we issue the refund to your original payment method.
Refunds under statutory rights are processed within 14 days of receipt of the returned goods. Refunds under the Pregnancy Refund Offer are typically processed within 5 business days of receipt.
10. Personal data
How we collect, use, share, and protect your personal data is governed by our Privacy Policy. The Privacy Policy explains the lawful bases on which we process your data, the elevated protections we apply to fertility-related data (treated as special-category data under UK GDPR), and your rights as a data subject.
You can withdraw consent for marketing communications at any time using the unsubscribe link in every marketing email, by changing your account settings, or by emailing customerservice@fertility-smart.net.
11. Limitation of liability
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Any matter for which it would be illegal to exclude or limit liability.
- Your statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
Subject to those exceptions, our total liability to you for any loss arising from a contract with us is limited to the price you paid for the relevant goods.
We do not exclude or restrict liability for breach of any term implied by the Consumer Rights Act 2015 that the goods will be of satisfactory quality, as described, or fit for purpose — any attempt to do so would not be binding on you (Section 62 Consumer Rights Act 2015 unfair terms test).
12. Events outside our control
We are not liable for failure to perform our obligations under these Terms when the failure is caused by events outside our reasonable control — for example carrier disruption, regulatory changes, customs delays, or natural events. Where such an event affects your order, we will let you know and work with you on a solution. This does not affect your statutory rights.
13. Changes to these Terms
We may update these Terms from time to time, for example to reflect a change in the law. The “Last updated” date at the top of this page shows when the most recent version came into effect. Your order will be governed by the version of the Terms in force at the time you placed the order, unless a later legal requirement says otherwise.
14. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising under or in connection with these Terms is subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in another part of the United Kingdom, the laws of your home jurisdiction apply where they give you greater protection.
15. Product disclaimer
FertilitySmart Conceive For Women and Conceive For Men are food supplements. They are not intended to diagnose, treat, cure, or prevent any disease. They should not be used as a substitute for a varied and balanced diet and a healthy lifestyle. If you are pregnant, trying to conceive, breastfeeding, taking medication, undergoing fertility treatment (IVF, IUI, ICSI), or under medical supervision, consult your doctor before use.
